Texas Student who got expelled for not standing during the Pledge of Allegiance sues the Principal & School District.

India Landry , from Windfern High School, was expelled Monday morning for not standing during the Pledge of Allegiance. 

 The young girl had texted her mother earlier that she wasn't feeling well and to pick her up, said Mom. During class the teacher tried to confiscate her phone but India did not give it to the teacher so she was sent to the principal's office. While she was sitting feeling sick, Principal Martha Strother and other staff stood for the Pledge of Allegiance but India remained seated as she had done before 200+ other times at Windfern. Strothers took offense to India not standing and told her she had 5 minutes to leave school or she would be escorted by the police, so the young girl left. 

 The Landry family filed suit against Cypress-Fairbanks ISD and Principal Strother in federal court the following Saturday, citing the violation of the girl's First Amendment rights.Their lawyer Kallinen said "She was damaged. You can't just throw people out of school. Kallinen also said Landry and her daughter are seeking an undisclosed amount in damages for mental anguish.
